Welcome to Bow Tie Kreative! By engaging with our services, you agree to the following Terms of Service. Please read them carefully, as they outline the expectations and conditions under which we operate.
1. Service Overview
Bow Tie Kreative provides website design, digital marketing, and related creative services. Our services are customized to meet the specific needs of each client, based on the agreed-upon scope and project requirements.
2. Location
Bow Tie Kreative is located in Calgary, Alberta, Canada. All services are provided under the jurisdiction of the laws of Alberta.
3. No Refund Policy
All payments to Bow Tie Kreative are non-refundable. Once a project has commenced, clients are expected to go through the full process as outlined in the project scope. Cancellations or changes to the agreement do not warrant a refund under any circumstances.
4. Project Management Tools and Communication
To ensure efficient project management, all clients must sign up and actively use our designated Project Management (PM) tools, such as [Insert PM Tool Name(s)], where all project-related communication, progress tracking, and file sharing will occur. This ensures transparency and keeps everything organized throughout the project lifecycle.
5. Scope of Work
Before starting a project, Bow Tie Kreative and the client will define and agree on the project scope, deliverables, timeline, and costs. The agreed-upon scope will be strictly adhered to unless explicitly modified in writing.
6. Scope Creep and Change Requests
- Scope Creep: Any work requested by the client that falls outside the agreed-upon scope of work is considered scope creep. This includes any new features, design changes, or functionality not initially discussed or accounted for in the project brief.
- Change Requests: If the client wishes to make changes to the original scope, they must submit a formal change request. The request will be evaluated, and any approved changes will be billed separately according to the additional time and resources required. Clients will be informed of potential delays to the original timeline resulting from such changes.
- Charges for Scope Creep: Any additional work due to scope creep will be charged at Bow Tie Kreative’s standard hourly rate or as agreed upon prior to commencement of the extra work.
7. Bug Fixes and Revisions
- Bug Fixes: If any bugs or errors are identified in the project deliverables within 30 days, Bow Tie Kreative will correct these at no additional charge, provided the bug falls within the originally agreed-upon scope.
- Bugs vs. Scope Creep: Issues or requests that are determined to be outside the original scope or classified as scope creep will be treated as change requests and billed accordingly. Bow Tie Kreative reserves the right to determine whether a client request is a bug or scope creep.
8. Client Responsibilities
Clients are expected to:
- Provide all necessary content, feedback, and approvals promptly to avoid delays.
- Use the assigned project management tools for communication and task tracking.
- Respect the agreed-upon project scope and avoid unnecessary changes that lead to scope creep.
9. Limitation of Liability
Bow Tie Kreative is not liable for any direct, indirect, incidental, or consequential damages resulting from the use of our services or project outcomes. Clients assume full responsibility for the final approval of all deliverables.
10. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Province of Alberta. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts of Alberta.
